Privacy Policy
This Personal Data Privacy Policy (hereinafter referred to as the "Privacy Policy") applies to all information that NR LLC (hereinafter referred to as the "Operator") may obtain about the User via the Internet through the website or mobile application of the online store https://academy.nara.kz (hereinafter referred to as the "Online Store").
1. Definition of Terms:
1.1 "Website" - the website located on the Internet at https://academy.nara.kz.
All exclusive rights to the Website and its individual elements (including software, design, and posted documents) belong in full to the Operator. The transfer of exclusive rights to the User is not covered by this Privacy Policy.
1.2 "Website Administration" - employees authorized to manage the Website, acting on behalf of the Operator, who organize and/or process personal data, and determine the purposes of personal data processing, the scope of personal data to be processed, and the actions (operations) performed with personal data.
1.3 "Personal Data" - any information relating directly or indirectly to an identified or identifiable individual (personal data subject).
1.4 "Personal Data Processing" - any action (operation) or set of actions (operations) performed with personal data, with or without the use of automated tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of personal data.
1.5 "Personal Data Confidentiality" - a mandatory requirement for NR LLC or any other person who has access to personal data to prevent its dissemination without the consent of the personal data subject or other legal grounds.
1.6 "User" - any person who accesses and uses the online store via the Internet.
1.7 "Cookies" - a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request each time an attempt is made to open a page of the corresponding website.
1.8 "IP Address" - a unique network address of a node in a computer network built using the IP protocol.
1.9 "Cross-border Transfer of Personal Data" - the transfer of personal data to a foreign government agency, foreign individual, or foreign legal entity.
2. General Provisions
2.1 This Privacy Policy is based on the Law of the Republic of Kazakhstan dated May 21, 2013, No. 94-V "On Personal Data and Its Protection" and applies to all information the Operator may receive about the User while using the website https://academy.nara.kz.
2.2 By submitting personal data and other information to the Operator through the Website, the User confirms their consent to the use of such data under the terms set forth in this Privacy Policy.
2.3 If the User does not agree with the terms of this Privacy Policy, they must stop using the Website.
2.4 The Operator's Website may contain links to other websites. Please be aware that the Operator is not responsible for the privacy practices of websites not operated by the Operator. We recommend that you review the privacy policy of each website that collects any personal information.
2.5 This Privacy Policy applies solely to information collected by the Operator.
2.6 The Operator does not verify the veracity of the personal data provided by the User. However, the Operator assumes that the User provides accurate personal data and keeps this data up to date. The User bears full responsibility, as well as any possible consequences, for providing inaccurate or outdated personal data.
3. Subject of the Privacy Policy
3.1 This Privacy Policy sets forth the Operator's obligations to maintain confidentiality and ensure the protection of the privacy of personal data that the User provides at the Operator's request when registering on the Website, placing an order for Services, or using any of the Website's Services.
3.2 Personal data permitted for processing under this Privacy Policy may include the following information:
- User's last name, first name, and patronymic;
- User's contact phone numbers;
- Email address;
- User's date of birth.
3.3 The Website protects non-personal data:
- IP address;
- cookie information;
- Information about the browser (or other program that accesses ad display);
- Access time.
3.4 Disabling cookies may result in inability to access parts of the Website that require authorization.
3.5 The Website collects statistics on the IP addresses of its Visitors. This information is used to identify and resolve technical issues.
3.6 Any other personal information not specified above (the User's history of requests to the Operator, browsers and operating systems used, etc.) is subject to secure storage and non-dissemination, except as provided in paragraphs 5.2 and 5.4 of this Privacy Policy.
4. Purposes of Personal Data Collection
4.1 The Operator collects and stores only the Personal Data necessary for the provision of the Operator's Services and interaction with the User.
4.2 Personal Data may be used for the following purposes:
- Providing Services to the User;
- User identification;
- Interacting with the User;
- Sending the User advertising materials, information, and requests;
- Conducting statistical and other research.
4.3 The User is prohibited from providing personal data of third parties on the Website (except when representing the interests of such persons, provided that the third party provides documentary evidence to support such actions).
5. Procedure and Timeframe for Processing Personal Data
5.1 The User's personal data may be processed indefinitely, by any legal means, including in personal data information systems, with or without the use of automated tools.
5.2 The Operator undertakes to use the Personal Data in accordance with the Law "On Personal Data" of the Republic of Kazakhstan and the Operator's internal documents. The User's Personal Data and other data will be kept confidential, except in cases where such data is publicly available.
5.3 The Operator has the right to transfer Personal Data and Non-Personal Data without the User's consent to the following parties:
- government agencies, including inquiry and investigative bodies, and local governments upon their reasoned request;
- in other cases expressly provided for by the legislation of the Republic of Kazakhstan.
5.4 The Operator has the right to transfer Personal Data to third parties not specified in paragraph 5.3 of this Privacy Policy in the following cases:
- the User has expressed their consent to such actions;
- the transfer is necessary for the User's use of the Website or the provision of Services to the User.
6. Protection of Personal Data
6.1 The Operator ensures appropriate protection of Personal and other data in accordance with the Law and takes necessary and sufficient organizational and technical measures to protect Personal Data.
6.2 The security measures applied, among other things, protect Personal Data from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, and other illegal actions by third parties.
6.3 Before undertaking any cross-border transfer of personal data, the Operator is obliged to ensure that the foreign state to which the personal data is intended to be transferred ensures reliable protection of the rights of personal data subjects.
6.4 Cross-border transfer of personal data to foreign states that do not meet the above requirements may only be carried out with the personal data subject's written consent to the cross-border transfer of their personal data and/or the execution of an agreement to which the personal data subject is a party.
7. Other Provisions
7.1 This Privacy Policy and the relationship between the User and the Operator arising from the application of the Privacy Policy are governed by the laws of the Republic of Kazakhstan.
7.2 All possible disputes arising from this Agreement shall be resolved in accordance with the laws of the Operator's registered office. Before filing a lawsuit, the User must comply with the mandatory pre-trial procedure and submit a written claim to the Operator. The response period for such a claim is 30 (thirty) business days.
7.3 If, for any reason, one or more provisions of the Privacy Policy are deemed invalid or unenforceable, this shall not affect the validity or applicability of the remaining provisions of the Privacy Policy.
7.4 The Operator reserves the right to unilaterally amend the Privacy Policy (in whole or in part) at any time without prior consent from the User. All changes shall take effect upon their posting on the Website.
7.5 The User undertakes to independently monitor changes to the Privacy Policy by reviewing the current version.
